AI Act Article 4: The Obligation That's Already Active (And What It Means)

Article 4 of the EU AI Act — the AI literacy obligation — has been in force since February 2025. Here's what it actually requires, what 'sufficient literacy' means in practice, and how to implement it.

The obligation nobody's talking about

While most of the AI Act discourse focuses on high-risk systems, conformity assessments, and the proposed Omnibus delays, there's one provision that gets remarkably little attention — despite being the only AI Act obligation that's already fully in force.

Article 4 of the EU AI Act requires that providers and deployers of AI systems "take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf."

This provision entered into force on February 2, 2025. Not 2026. Not 2027. Over a year ago.

If your organisation uses AI in any capacity — and in 2026, that means virtually every organisation — Article 4 applies to you right now. There's no size threshold, no sector exemption, and no "we're still figuring it out" grace period.

What Article 4 actually says

The full text is worth reading carefully:

Providers and deployers of AI systems shall take measures to ensure, to their best extent, a sufficient level of AI literacy of their staff and other persons dealing with the operation and use of AI systems on their behalf, taking into account their technical knowledge, experience, education and training and the context the AI systems are to be used in, and considering the persons or groups of persons on whom the AI systems are to be used.

There's a lot packed into this single article. Let's unpack the key elements.

"Providers and deployers" — This covers both companies that build AI systems and companies that use them. If you deploy ChatGPT, Copilot, or any AI-powered SaaS tool, you're a deployer. Article 4 applies.

"Staff and other persons dealing with the operation and use" — This isn't limited to the technical team. It includes anyone who interacts with AI systems as part of their work. Marketing teams using AI content tools. HR using AI recruitment screening. Sales teams using AI-powered CRMs. Customer service agents working alongside AI chatbots. All of them.

"Sufficient level of AI literacy" — This is the key phrase, and intentionally vague. The Act doesn't prescribe a specific training program or certification. It sets a functional standard: people need to know enough to do their jobs properly in the context of AI.

"Taking into account their technical knowledge, experience, education and training" — Literacy requirements are contextual and role-specific. A machine learning engineer needs different literacy than a marketing coordinator. The Act recognises this explicitly.

"Considering the persons or groups of persons on whom the AI systems are to be used" — This is the most overlooked clause. Your staff need to understand not just how the AI works, but how it affects the people on the receiving end. A recruiter using AI screening needs to understand how it might impact candidates. A customer service agent working with AI triage needs to understand how it affects customers.

What "sufficient AI literacy" means in practice

The AI Act doesn't define a minimum standard for literacy. This is deliberate — a one-size-fits-all standard would be either too low for high-risk contexts or too burdensome for low-risk ones. Instead, the Act establishes a principle that organisations must interpret for their specific situation.

Based on the Act's text, recitals, and emerging guidance from the EU AI Office, "sufficient literacy" means your staff should understand:

1. What AI is and isn't. Basic conceptual understanding — that AI systems are statistical, not deterministic; that they can produce confident-sounding but incorrect outputs; that they reflect patterns in training data, including biases.

2. What AI systems they interact with. People should know which of their tools use AI, what the AI component does, and what its limitations are. This sounds basic, but most employees can't tell you which of their daily tools use AI and which don't.

3. How to use AI systems appropriately. Role-specific knowledge about proper use, including when to trust AI outputs, when to verify them, when to escalate, and what the system should and shouldn't be used for.

4. How AI affects the people it's used on. Understanding the downstream impact — how an AI-ranked candidate list affects job seekers, how an AI credit score affects customers, how an AI-generated response affects the person reading it.

5. The organisation's AI policies and procedures. Knowing what's allowed, what's not, where to report concerns, and who's responsible for AI governance within the organisation.

How to implement AI literacy (practically)

The good news about Article 4 is that implementation doesn't require expensive consultants, complex technology, or months of preparation. It requires structured thinking, documented effort, and ongoing commitment.

Here's a practical framework:

Step 1: Map your AI landscape

Before you can train people, you need to know what AI systems exist in your organisation and who uses them. This inventory is the foundation for everything — you'll need it for Article 4, and you'll need it again later for transparency (Article 50) and high-risk compliance.

Catalogue every AI-powered tool in use. Include the obvious ones (ChatGPT, Copilot, AI meeting transcription) and the embedded ones (AI features in your CRM, HR platform, customer service tools). Map each tool to the teams and roles that use it.

Step 2: Define role-specific literacy requirements

Not everyone needs the same training. Create tiers based on how people interact with AI:

General awareness (all staff): What AI is, your organisation's AI policy, basic principles of responsible use, how to report concerns. This can be a 30-minute module.

Operational literacy (AI tool users): Specific training on the AI tools someone uses in their role. How the tool works, its limitations, when to trust outputs, when to verify. This is tool-specific and role-specific.

Decision-maker literacy (managers and executives): Understanding AI governance obligations, risk assessment basics, the AI Act's requirements, and how to evaluate AI proposals and vendor claims. Focus on judgment, not technical detail.

Technical literacy (IT, data, and AI teams): Deeper understanding of model capabilities and limitations, bias and fairness, testing and validation, documentation requirements, and the technical aspects of AI Act compliance.

Step 3: Deliver training

The format matters less than the substance. What works:

  • Short, focused modules — 20-30 minutes per topic, not day-long workshops
  • Role-specific content — a recruiter's training looks different from a finance analyst's
  • Practical examples — use the actual tools your team uses, not abstract AI concepts
  • Regular refreshers — AI capabilities change rapidly; annual training is not enough
  • Interactive elements — quizzes, scenario exercises, "spot the AI" activities

What doesn't work: a single generic "AI awareness" presentation once a year. That checks a box, but it doesn't create sufficient literacy.

Step 4: Document everything

This is where Article 4 compliance gets concrete. Regulators don't ask "did your people learn?" — they ask "what measures did you take?" Document:

  • Your AI systems inventory
  • Your literacy framework and role-specific requirements
  • Training materials and curricula
  • Attendance and completion records
  • How training is updated when tools change
  • How you assess whether literacy is "sufficient"

This documentation is your evidence of compliance. Without it, you have training. With it, you have a compliance programme.

Step 5: Make it ongoing

AI literacy isn't a project — it's a process. New AI tools are adopted constantly. Existing tools add AI features. Staff change roles. The regulatory landscape evolves. Your literacy programme needs a maintenance cycle:

  • Review and update the AI inventory quarterly
  • Refresh training content when major tools change
  • Onboard new employees into the literacy programme
  • Reassess literacy requirements as your AI usage evolves

Why this is the easiest compliance win

Among all the AI Act's obligations, Article 4 offers the best effort-to-value ratio:

Low implementation cost. Training programmes don't require expensive technology. The core materials can be developed in-house or with minimal external support.

Already mandatory. Unlike high-risk obligations (which may be extended to 2027), literacy requirements are in force now. Implementing them isn't just good practice — it's legal compliance.

Foundation for everything else. A workforce that understands AI is better equipped to identify risks, flag misuse, implement governance, and use AI effectively. Literacy makes every other compliance activity easier.

Visible to customers and partners. Being able to demonstrate a structured AI literacy programme is increasingly valuable in procurement processes, partnership discussions, and customer trust-building.

Low risk of over-investment. Unlike high-risk compliance (where scope and requirements may shift), literacy is a safe bet. No future regulation will conclude that training your staff on AI was unnecessary.

The literacy gap is a governance gap

Organisations that skip AI literacy don't just fail a regulatory checkbox. They create a governance gap that amplifies every other risk. Staff who don't understand AI can't identify when it's being misused. Managers who don't understand AI can't make informed procurement decisions. Executives who don't understand AI can't set effective strategy or policy.

Article 4 isn't bureaucratic overhead. It's the foundation of responsible AI deployment. The fact that it's already mandatory is a reason to act, not an inconvenience to manage.
