AI Act for Swedish Companies: What You Need to Know
Sweden has some of Europe's highest AI adoption rates but dangerously low awareness of the EU AI Act. This guide covers what Swedish business leaders need to know — including the role of IMY, common Swedish tools, and why there is no grace period.
High adoption, low awareness
Sweden is one of the most AI-advanced economies in Europe. The government's national AI strategy, strong digital infrastructure, and a culture of early technology adoption mean that Swedish companies — from enterprise to startup — have embraced AI tools faster than most of their European peers.
That same speed of adoption is now a liability.
In surveys conducted in late 2025, fewer than 20% of Swedish mid-market companies could accurately describe the EU AI Act's requirements. Among those using high-risk AI systems in hiring, credit, or customer service, awareness was even lower. The assumption seemed to be: "This is about big tech and facial recognition. It doesn't apply to us."
It does. The EU AI Act is a regulation, not a directive. That means it applies directly in Sweden — no transposition into Swedish law needed, no national implementation timeline, no grace period. When obligations kick in, they kick in for every company operating in the EU, Swedish companies included.
What the AI Act is (in 60 seconds)
The EU AI Act is the world's first comprehensive law regulating artificial intelligence. It classifies AI systems by risk level and assigns obligations accordingly:
- Unacceptable risk — Banned entirely. Social scoring, manipulative AI, real-time biometric identification in public spaces (with narrow exceptions).
- High risk — Heavy obligations: technical documentation, human oversight, conformity assessment, monitoring, registration. Applies to AI in hiring, credit scoring, education, critical infrastructure, law enforcement, and more.
- Limited risk — Transparency obligations. Users must be told they're interacting with AI.
- Minimal risk — No specific obligations, but general AI literacy requirements apply.
The regulation also creates a separate regime for general-purpose AI (GPAI) models — the foundation models like GPT-4, Claude, and Gemini that power many applications.
For Swedish companies, the practical question is: which category do your tools fall into, and what do you need to do about it?
The Swedish context: why this matters here specifically
IMY will enforce the AI Act
Integritetsskyddsmyndigheten (IMY) — Sweden's data protection authority — has been designated as the national competent authority for the AI Act. This is the same body that enforces GDPR in Sweden.
If you've dealt with IMY on data protection, you know they're thorough and increasingly active. In 2025, IMY issued several significant GDPR enforcement decisions and has publicly stated they are building capacity for AI Act supervision.
IMY will work alongside the European AI Office, which oversees GPAI model providers and coordinates cross-border enforcement. But for most Swedish companies — those deploying or providing AI systems within Sweden — IMY is your primary regulator.
What this means in practice: Don't expect a soft launch. IMY has institutional experience with complex technology regulation (GDPR), an established complaints-handling process, and a track record of enforcement. When the high-risk obligations apply from August 2026, expect them to be enforced.
Swedish tools in the crosshairs
Swedish companies don't just use AI — they build and sell it. Several widely used tools in the Swedish market have significant AI Act implications:
Teamtailor — Sweden's most popular ATS, used by thousands of Nordic companies. Teamtailor's AI-powered candidate screening and ranking features fall squarely under Annex III, point 4(a): AI systems intended to be used for recruitment. This makes it high-risk. Every Swedish company using Teamtailor's AI screening features is a deployer of a high-risk AI system, with corresponding obligations for human oversight, candidate notification, and impact assessment.
Visma — The Nordic enterprise software giant offers AI features across its product suite: Visma.net Autopilot for accounting automation, AI-powered payroll predictions, and machine learning in financial planning tools. If these AI features make or influence decisions in areas covered by Annex III (e.g., credit-related, access to essential services), they could be high-risk. At minimum, transparency obligations apply.
Fortnox — Sweden's dominant accounting platform for SMEs has been adding AI features: automated bookkeeping suggestions, invoice classification, and cash flow predictions. For most use cases, these are likely minimal or limited risk. But if Fortnox AI features are used to inform creditworthiness assessments or financial decisions about individuals, the risk classification could shift.
Klarna — While Klarna is a fintech rather than a tool most companies deploy, its AI assistant and AI-powered credit decisions are highly relevant. Klarna's AI systems for credit assessment are unambiguously high-risk under Annex III, point 5(b). If you use Klarna's merchant tools that incorporate AI decision-making, understand the shared compliance picture.
Spotify (for ML teams) — Sweden's tech flagship has published extensively on responsible AI. While most companies aren't deploying Spotify, its ML practices and open-source tools (like Backstage) set norms in the Swedish tech community. The AI Act will formalize many practices Spotify already follows voluntarily.
The co-determination dimension
Sweden's strong labor law tradition adds a layer that many AI Act guides overlook. Under the Medbestämmandelagen (MBL — Co-Determination Act), employers must negotiate with unions before making important changes to working conditions. Introducing AI systems that monitor, evaluate, or allocate work to employees is almost certainly a matter for MBL negotiation.
The AI Act's requirement to inform worker representatives (Article 26(7)) aligns with existing Swedish co-determination obligations, but the combination means Swedish employers face a dual compliance requirement: the AI Act mandates it, and Swedish labor law provides unions with negotiation rights beyond mere notification.
If you have collective agreements (which most Swedish companies with more than 25 employees do), involve your union representatives early. This is both a legal requirement and practically smart — getting union buy-in for AI tool deployment avoids conflicts later.
The most common compliance gaps in Swedish companies
Based on our work with Nordic organizations, these are the patterns we see most often:
1. "We just use the tools — the vendor handles compliance"
This is the most dangerous misconception. Under the AI Act, deployers have independent obligations. Your vendor (provider) must give you documentation and instructions, but you must implement human oversight, conduct impact assessments, inform affected individuals, and maintain records. The vendor can't do this for you.
2. HR tools adopted without risk assessment
The average Swedish company with 200+ employees uses 2-4 AI-enabled HR tools. Most were adopted by People teams based on feature demos, not risk assessments. Teamtailor's AI screening in particular is so ubiquitous in Sweden that many HR teams don't even think of it as "AI" — it's just how the ATS works. It's still high-risk.
3. No AI inventory
You can't comply with regulations on tools you haven't cataloged. Many companies have no central record of which AI tools are used, by whom, and for what purpose. Shadow AI — employees using ChatGPT, Copilot, or other tools without formal approval — makes this worse.
4. GDPR compliance assumed to cover AI Act
GDPR and the AI Act overlap but don't replace each other. A DPIA under GDPR is necessary but not sufficient for AI Act compliance. The AI Act adds requirements for technical documentation, conformity assessment, post-market monitoring, and fundamental rights impact assessment that go beyond data protection.
5. Waiting for industry guidance
The Swedish AI ecosystem is strong — AI Sweden, RISE, and various industry groups are producing guidance. But guidance is not compliance. The regulation is the regulation, and the deadlines don't shift because guidance papers haven't been published yet.
Step-by-step: what Swedish companies should do now

[ ] Appoint an AI Act lead — Someone in your organization needs to own this. It could be your DPO, CTO, Head of Legal, or a dedicated compliance role. What matters is that one person is accountable for the company's AI Act readiness.

[ ] Build your AI inventory — List every AI tool used in your organization. Include SaaS products with AI features, internal ML models, and informal tool usage. For each, document: what it does, who uses it, what data it processes, and what decisions it influences.

[ ] Classify your risk exposure — Map each tool against the AI Act risk categories. Pay special attention to Annex III (high-risk) categories relevant to Swedish business: employment (point 4), credit and insurance (point 5), access to services (point 5), and education (point 3).

[ ] Check if you're also a provider — If your company builds software with AI features sold to customers, you may be a provider with heavier obligations. This is common in Sweden's SaaS ecosystem.

[ ] Engage IMY proactively — Monitor IMY's AI Act publications and guidance. Attend their webinars. If you have specific questions about classification, asking early is better than guessing wrong.

[ ] Involve union representatives — For any AI system affecting workers, initiate MBL negotiations. This includes performance monitoring, task allocation, and scheduling tools with AI components. Document the process.

[ ] Update privacy notices and HR policies — Add AI disclosure to your integritetspolicy, candidate communications, and employee handbook. Be specific about which tools use AI and how.

[ ] Conduct impact assessments — For high-risk systems: complete a DPIA (GDPR) and fundamental rights impact assessment (AI Act). These can be combined but must cover both frameworks.

[ ] Review vendor contracts — Ensure your agreements with AI tool vendors include obligations for them to provide technical documentation, instructions for use, and support for your compliance obligations. Swedish companies often use English-language SaaS contracts that don't mention the AI Act — update them.

[ ] Implement AI literacy training — Article 4 requires AI literacy for all staff working with AI. This applies from August 2, 2025. In Swedish: everyone who uses AI tools in their work needs training on what AI can and can't do, and what the rules are.

[ ] Set up monitoring and logging — For high-risk systems, you need audit trails of AI-assisted decisions. Ensure your tools provide adequate logging, and that you're storing these logs for at least six months.

The Swedish advantage (if you act now)
Here's the encouraging part: Swedish companies are actually well-positioned to comply with the AI Act — if they start now.
Sweden's strong data protection culture (GDPR was adopted relatively smoothly here), high digital literacy, and institutional trust in regulation mean that the building blocks for compliance are already in place. Many Swedish companies already do impact assessments, already have DPOs, and already have frameworks for structured technology governance.
The gap is awareness and specificity, not capability. Most Swedish organizations can comply with the AI Act — they just haven't started the work yet because they didn't realize they needed to.
The companies that move first will have a genuine advantage: smoother vendor negotiations, cleaner audit trails, and the ability to tell customers and partners "we're AI Act ready" before it becomes table stakes.
